What Minnesota is doing about PFAS

Minnesota was at the center of one of the largest PFAS settlements in U.S. history. In 2018 the state settled a lawsuit against 3M for 850 million dollars to address contamination of drinking water supplies in the East Metro area of the Twin Cities, where 3M had manufactured and disposed of PFAS for decades. Funds from the settlement have paid for treatment plants, alternate water supplies, and ongoing monitoring in affected communities.

The Minnesota legislature passed HF 2310 in 2023, known as Amara's Law after Amara Strande, a young woman who died of a rare cancer and grew up in the affected East Metro area. The law bans the sale of products containing intentionally added PFAS in several categories starting in 2025, with broader bans through 2032. Minnesota is one of the few states matching Maine's aggressive product-level approach.

The Minnesota Department of Health has published health-based values for several PFAS compounds that are used as drinking water guidance values, including a PFOA value of 35 parts per trillion based on older toxicology, now superseded for enforcement purposes by the federal EPA MCLs. The Minnesota Pollution Control Agency continues to monitor groundwater contamination at the 3M Cottage Grove, Oakdale, and Woodbury disposal sites.

Public water systems in Minnesota are subject to the federal compliance timeline requiring initial monitoring by 2027 and treatment installation by 2029, in addition to ongoing state monitoring requirements under the 3M consent order.
