What Maine is doing about PFAS

Maine has enacted some of the strictest PFAS laws in the country. LD 1503, signed by Governor Janet Mills in 2021, requires reporting of intentionally added PFAS in products sold in Maine and bans the sale of most consumer products containing intentionally added PFAS by 2030. The law was amended in 2023 to stagger effective dates and add exemptions for specific uses, but the core product ban remains.

Maine's drinking water response began after the Maine Department of Environmental Protection discovered widespread farm contamination from biosolids land-applied as fertilizer, most famously on the Stoneridge Farm in Arundel and farms in Fairfield. The state created an interim PFAS drinking water standard of 20 parts per trillion for the combined total of six PFAS compounds, including PFOA, PFOS, PFHxS, PFHpA, PFNA, and PFDA.

The Maine legislature appropriated tens of millions of dollars for farm remediation, blood testing programs, and impacted household compensation through the PFAS Fund. State records show Maine has required all public water systems to sample for PFAS under the state standard, in addition to federal UCMR 5 requirements.

Litigation has been ongoing. The Maine Attorney General has joined multistate actions against 3M and DuPont, and Maine farmers have pursued separate claims against biosolids handlers. Public water systems are subject to both the Maine 20 parts per trillion combined standard and the federal compliance timeline requiring initial monitoring by 2027 and treatment installation by 2029.
